MAGALONG BINUHAY ANG KASO NG SAF 44 VS EX-PNOY

NAKIISA kahapon si Baguio City Mayor Benjamin Magalong sa mga kaanak ng nasawing 44 Special Action Force (SAF) members sa tinaguriang 2015 Mamasapano clash na muling buksan ng Ombudsman ang imbestigasyon sa naturang insidente.
Si Magalong, na isang retiradong police official, ay sinisisi si dating Pangulong Benigno ‘Noynoy’ Aquino III sa pagsuway ng chain-of-command sa pagpapatupad ng naturang misyon na ikinasawi ng SAF troopers.
Ang tinutukoy ni Magalong ay ang naging desisyon ni Aquino na hindi ipaalam sa noo’y Philippine National Police (PNP) officer-in-charge Leonardo Espina ng Oplan Exodus, ang misyon na tugisin ang mga teroristang sina Zulkifli Bin Hir at Basit Usman.
Sa halip, tinalakay at inaprubahan ni Aquino ang Oplan Exodus kay Philippine National Police chief Alan Purisima, na noong panahong iyon ay nasa ilalim ng suspensyon dahil sa kasong korapsyon, at sa nakatalaga noon na si SAF chief Getulio Napeñas.
Nagawang mapatay ng 44 SAF members si Usman subalit kinalaunan sila ay inatake at napatay ng pinagsamang puwersa ng Moro Islamic Liberation Front (MILF) fighters at iba pang armed groups sa naturang lugar.
Sa imbestigasyon ng PNP’s Board of Inquiry, na pinamumunuan ni Magalong, napag-alaman na ang Oplan Exodus ay hindi rin nakipag-coordinate sa military at sa government peace panel na nakikipag-usap sa MILF.
“The Chain of Command was violated when the President, suspended PNP Chief Purisima and Napeñas kept the information to themselves and deliberately failed to inform Espina and Department of the Interior and Local Government Secretary Mar Roxas II. The chain of command should be observed in running mission operations,” pahayag ni Magalong sa kanyang inihaing affidavit sa Office of the Ombudsman.
“Oplan Exodus can never be executed effectively because it was defective from the beginning. It is clearly evident that former President Benigno Aquino III, being then the commander-in-chief of the Armed Forces of the Philippines, should be held accountable and responsible for the deaths of the SAF 44 troopers in the botched Oplan Exodus in Mamasapano, Maguindanao with Purisima and Napeñas in violation of the Chain of Command in the PNP,” dagdag nito.
Lumabas si Magalong halos tatlong buwan matapos na pagbigyan ng Sandiganbayan ang mosyon ni Ombudsman Samuel Martires na bawiin ang kasong graft at usurpation charges na inihain laban kay dating Pangulong Aquino sa pagkamatay ng 44 SAF members, na nagsasabing hindi sapat ang hawak nilang ebidensya upang magpatuloy ang kaso.
“Considering that the records of the present cases are bereft of any evidence that would merit further proceedings as against accused Aquino for the char-ges in violation of Section 3 of RA 3019 (Anti Graft and Corrupt Practices Act) and usurpation of official functions under Article 177 of the Revised Penal Code, the Court finds that the dismissal the said cases is indeed warranted,” ayon sa desisyon ng Sandiganbayan Fourth Division’s.
Taong 2017 naman nang i-dismiss ng Obudsman ang reklamo laban kina ex-PNoy, Purisima at Napeñas para sa reckless imprudence resulting in multiple homicide dahilan sa kakulangan ng probable cause.
Nang tanungin ang Ombudsman kung maaaring muli itong imbestigahan ‘despite a finding of no probable cause by the high court itself’, sinabi ni Chief Justice Diosdado Peralta na: “Let Ombudsman Martires rule on that.”
